Terms of Service
Effective from: 2026-10-01 · v1.0
§1 General provisions
This is an English translation provided for convenience. The Polish version of these Terms is the legally binding one.
These terms (the “Terms”) set out the rules for using the website available at chocoyeee.pl (the “Website”), where we present the CHOCOYEEE Croissant product and invite businesses to trade with us.
The Website is operated by TRUDERS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (Truders limited liability company), with its registered office in Olsztyn, ul. Marii Zientary-Malewskiej 55, 10-310 Olsztyn, Poland, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court in Olsztyn, 8th Commercial Division of the National Court Register, under KRS number 0000631235, tax ID (NIP) 7393887474, REGON 365107318, share capital PLN 30,000.00 (the “Service Provider” or “we”). Contact: email biuro@truders.pl, phone +48 604 571 026.
These Terms are terms for the provision of services by electronic means within the meaning of Article 8 of the Polish Act of 18 July 2002 on the Provision of Services by Electronic Means. We make them available free of charge on the Website in a form that allows them to be downloaded, saved and printed.
Terms used herein have the following meaning:
- User - any person using the Website, including a person acting on behalf of a business;
- Consumer - a natural person who performs a legal act with us that is not directly related to their business or professional activity;
- Business - a natural person, legal person or organisational unit conducting business or professional activity that uses the Website in connection with that activity (e.g. a vending machine operator, a gas station, a retail chain or a wholesaler);
- Services - the services provided by electronic means through the Website, described in §2;
- Form - the “Become our partner” form in the contact section of the Website, used to send an enquiry about trade cooperation.
§2 Types and scope of the Services
Through the Website we provide the following Services free of charge:
- browsing content - access to information about the product, its specifications, logistics and sales channels;
- the Form - the option to send us an enquiry about cooperation and a trade offer (see §5);
- downloadable materials - access, without registration, to the product presentation in PDF format (in Polish, English and German) and to the product sheet;
- language switcher - displaying the Website in Polish, English or German.
The Website does not require creating an account or logging in.
The Website is not an online shop and is not used to conclude sales contracts. Product information, including logistics data, is not an offer within the meaning of Article 66 of the Polish Civil Code but an invitation to trade negotiations. Terms of cooperation with Businesses are agreed individually. Single products can be bought in the online shop sklep.truders.pl, which is a separate website governed by its own terms and its own privacy policy.
§3 Conclusion and termination of the contract for the Services
- The contract for the Services of browsing content, downloading materials and the language switcher is concluded when the Website is opened in a browser and terminates when the User leaves it.
- The contract for the Form Service is concluded when the completed Form is sent and terminates when the Website accepts it. Further correspondence about the enquiry is no longer a Service provided by electronic means within the meaning of these Terms.
- The Services are free of charge. The User may stop using the Services at any time by closing the Website or by not sending the Form.
§4 Technical requirements and risks
To use the Website you need:
- a device with internet access (computer, tablet or phone);
- an up-to-date web browser (e.g. Chrome, Safari, Firefox, Edge) with JavaScript and encrypted connections (TLS) enabled;
- to open the product presentation - a PDF reader, built into most browsers;
- to send the Form - an active email address.
To remember your cookie decision, the browser must allow data to be stored in local storage (localStorage). If it does not, the Website still works, but the consent request may appear on every visit. Details are set out in the Cookie Policy.
Using any online service involves general risks such as malware, attempts to obtain data by deception (phishing) or interception of transmissions on unsecured networks. The Website works only over an encrypted HTTPS connection. We recommend using up-to-date software with security patches. We never ask for passwords or payment details on the Website.
We take care to keep the Website available at all times, but we may introduce short technical breaks needed for maintenance, updates or fixing failures.
§5 The “Become our partner” Form
In the Form you provide: full name, company name, email address and industry (required fields) and, optionally, a phone number and a message. The enquiry cannot be sent without the required fields.
Below the Form there is an optional checkbox for consent to phone contact and to receiving commercial information. Ticking it is not a condition for sending the enquiry or for handling it.
We reply to enquiries as quickly as possible, by electronic means or by phone. Sending the Form does not mean that a trade contract is concluded and does not oblige either party to conclude one.
To protect the Form against abuse, we limit the number of submissions sent from one IP address (5 submissions within 10 minutes) and use an anti-spam safeguard that is invisible to the User. Once the limit is exceeded, the enquiry can be sent again after a few minutes, or you can email us.
A User who provides another person's details (e.g. a colleague's) should be authorised to do so.
§6 Rules for using the Website
The User uses the Website in accordance with the law, good practice and these Terms. In particular, it is prohibited to:
- provide unlawful content, including content that infringes personal rights, copyright or data protection laws;
- send unsolicited commercial information, advertising unrelated to cooperation or false data through the Form;
- take actions that may disrupt the Website, including automated submissions, overloading the Website with excessive requests or attempts to bypass its safeguards.
§7 Complaints about the operation of the Website
Complaints about the operation of the Website (e.g. a page error, a Form that does not work, a problem downloading materials) can be sent to biuro@truders.pl or in writing to our registered office: ul. Marii Zientary-Malewskiej 55, 10-310 Olsztyn, Poland.
Please include your contact details, a description of the problem, the date it occurred and the device and browser you used. This helps us find the cause faster, but a complaint will not be left unanswered if this information is missing.
We reply to complaints within 14 days of receipt, to the email or postal address from which the complaint was sent.
Complaints about purchases made in the sklep.truders.pl shop are handled under that shop's terms.
§8 Consumer rights and out-of-court dispute resolution
The Website is addressed to businesses, but it may also be used by a Consumer. No provision of these Terms excludes or limits the rights that Consumers have under mandatory provisions of law.
A Consumer may use out-of-court complaint and redress procedures, in particular:
- apply to the permanent amicable consumer court operating at the regional inspector of the Trade Inspection (Inspekcja Handlowa);
- apply to the regional inspector of the Trade Inspection to initiate mediation proceedings;
- obtain free assistance from a district (municipal) consumer ombudsman or from a social organisation whose statutory tasks include consumer protection.
Information on these procedures is available at the offices and on the websites of the institutions listed above and on the website of the Polish Office of Competition and Consumer Protection (uokik.gov.pl).
§9 Copyright and trademarks
The content of the Website, in particular texts, photos, graphics, page layout, the product presentation and the product sheet, as well as the CHOCOYEEE name and logos, is protected by copyright or industrial property law. These rights belong to the Service Provider or to entities that have allowed us to use them, including the manufacturer of CHOCOYEEE products.
The content may be viewed and downloaded for your own use. Downloadable materials may be used to evaluate the offer and for internal discussions within your company. Any other use, in particular publishing, modifying or using them in sales materials, requires our prior consent, except where permitted by law. Trade partners receive rules for using brand materials as part of the cooperation.
§10 Links to external websites
The Website contains links to external websites, in particular:
- the WhatsApp button (a wa.me link), visible on business days between 8:00 and 16:00 - once clicked, the conversation takes place in WhatsApp under its provider's terms;
- the sklep.truders.pl online shop - a separate website with its own terms and privacy policy;
- the brand's social media profiles (Instagram, Facebook) and the truders.pl website.
The Website does not embed widgets of these services. Their providers are responsible, under their own terms, for how they work, for their content and for processing data once you go to them.
§11 Personal data and cookies
The controller of Users' personal data is the Service Provider. The purposes, legal bases, recipients and retention periods of the data and the rights of data subjects are described in the Privacy Policy.
The rules for using cookies and browser local storage are described in the Cookie Policy. You can change your cookie decision at any time using the “Cookie settings” link in the footer of the Website.
§12 Final provisions
We may amend these Terms for important reasons, in particular changes in the law, in the scope of the Services or in the technical solutions of the Website. The new version applies from the day it is published on the Website, with its effective date indicated. Services started before the change (e.g. a Form already sent) are governed by the version in force when they were started.
These Terms are governed by Polish law, in particular the Act on the Provision of Services by Electronic Means, the Civil Code and, with respect to Consumers, the Act of 30 May 2014 on Consumer Rights. The choice of Polish law does not deprive a Consumer habitually resident in another country of the protection afforded by the mandatory provisions of that country's law.
Disputes with Businesses are resolved by the court having jurisdiction over the Service Provider's registered office. Disputes with Consumers are resolved by the court having jurisdiction under general rules.
The Polish version of these Terms is the binding one. The English and German versions are translations.
These Terms are effective as of 1 October 2026.
